When a Tenant Dies

When a tenant dies, there are several different things which may happen.

  • If this is a joint tenancy, the surviving tenant should have the tenancy transferred into their sole name
  • If someone who has lived in the property for at least 12 months wishes to, they can apply to succeed to the tenancy, which would transfer the tenancy into their name.  If more than one resident of the property would like to succeed to the tenancy, a spouse or civil partner would have first priority, then a child of the deceased tenants, then any other resident
  • If the property is to be handed back to ELHA, we give the executors 14 days from the date of death rent free to clear the property and return the keys.
